Definitions

The Company is Crystal Clear Web Design

The Client is the company or individual who has engaged the services of Crystal Clear Web Design

The Website is the Website designed and built for the Client by Crystal Clear Web Design

General Terms & Conditions

1. The Client will own the copyright of the completed Website once full payment has been received, up until which point the Website will remain the copyright of Crystal Clear Web Design.

2. Crystal Clear Web Design will retain all the Intellectual Property Rights over any materials they have designed or produced as well as ownership of all working files and materials used to in the creation of the product, including all formats, whether printed, electronic or otherwise.

3. Crystal Clear Web Design will not assume responsibility nor be held liable for any copyright infringement and/or legal proceedings that arise out of the use of images, photographs, text content, registered trademarks, logos or any other copyrighted material that is supplied by the Client for inclusion on their Website. It is the sole responsibility of the Client to verify their entitlement to use any material supplied and the Company reserves the right to refuse any material in the event of any doubt about issues relating to copyright.

4. The Company will provide the Client with an expected completion date for the project. The Company will endeavour to meet any given deadline, but will not guarantee, and are not bound in any way, to complete the project by this date.

5. Whilst every endeavour will be made to ensure that the Website (including any scripts and other programming included) are free from errors, Crystal Clear Web Design cannot accept responsibility for any losses incurred either directly or indirectly due to malfunctioning of the Website or any of its parts.

6. It is the responsibility of the Client to fully check the content of the Website, and to check that it functions to their satisfaction and report any bugs or errors within 7 days of the website going live. After seven days, the Company is no longer liable and the Client must pay for any alterations or fixes and will be charged at the Company's existing hourly rate.

7. The Company uses the services of external hosting companies and whilst every effort is taken to ensure that these are reliable, the Company cannot be held liable for the correct functioning of the Website (including any scripts) or for any downtime of the Client's Website as a result of technical failure or other breakdown of the hosting Server, or for any loss of sales or profits deemed to have resulted from such incidences.

8. In the event that the Client already has their own hosting service or wishes to use a hosting service other than one recommended by the Company, the Company cannot and will not guarantee the correct functioning of the Website or any existing scripts (including form scripts) on that server. In the event of problems occurring in these circumstances, Crystal Clear Web Design will make every effort to remedy the problem, but any time spent as a result will be charged at the Company's standard hourly rate.

9. Whilst the Company will test the Client's Website on a variety of different browsers, platforms and screen resolutions and will take all the necessary steps to ensure that it functions correctly for the greatest number of users, it can give no guarantee that the Website will display or function correctly in all browsers.

10. The Company reserves the right to publish, for promotional purposes, a link from the Company's Website to the Client's Website together with a basic summary of the project, unless a different agreement has been made between the Company and the Client. The Company also reserves the right to include an accreditation and link to its own Website from the Client's Website, unless other arrangements have been made between the Company and the Client.

11. Domain name renewals must be confirmed and paid for in full at least one month prior to the renewal date.

12. By accepting a quotation - whether verbally, written or by email - from Crystal Clear Web Design for work to be undertaken, or by accepting a quotation for work as produced by Crystal Clear Web Design, the Client is agreeing to the complete Terms and Conditions, as laid out in this document, between the Company and the Client with regards to the Client's Website.

13. The Company retains the right to change these terms and conditions with no prior notice.

Payment Terms & Conditions

1. Payment of a non-refundable deposit is required in order for the Client to secure a time slot for the Company to start work on the Client's Website. A further payment is due on the final agreement of the page proofs. The remaining balance is due for full payment within seven days of the Website going live. If accounts are not settled within seven days of invoice date and the Company have not been contacted regarding the delay in payment, the Company reserves the right to restrict access to the Client's Website.

2. If the Client causes excessive delays to the project, either by non-submission of requested material or any other failure on the part of the Client, and these delays prevent the Website from being fully completed within two months of the quote being accepted, the Client will become liable for full payment immediately and any additional hours of work will be charged for at the Company's hourly rate.

3. The Website will remain the property of Crystal Clear Web Design until all outstanding accounts are settled in full. The Company reserves the right to withdraw any product or service that has not been paid for in full.

4. Payment terms are strictly 14 days from the date of invoice. Late payments will attract a monthly interest charge of 2% and the Company reserves the right to restrict access to the Client's Website.

5. Hosting is charged annually in advance. The Client has the right to cancel their hosting at any point up to four weeks prior to renewal date, with any remaining time left on the hosting being forfeited.

6. All hosting and domain registration fees are non-refundable, in whole or in part.

Terms of Use of the Company's Website

The Company's Website is the property of Crystal Clear Web Design and its access and use are subject to the following terms and conditions:

1. All the material and contents of the Company's Website, including text, graphics and images, are the copyright of Crystal Clear Web Design unless otherwise stated and may not be copied, reproduced, distributed or published for commercial use without the explicit agreement in writing from Crystal Clear Web Design.

2. Whilst every care is taken to ensure the accuracy of all content and information published on the Company's Website, Crystal Clear Web Design can make no representation or warranty, whether express or implied, as to its correctness or completeness. Furthermore, the Company does not assume any legal liability or responsibility for any claims arising from interpretation, misinterpretation, use or misuse of any information on the Company's Website. It is the responsibility of any visitor to this Website to take the necessary steps to verify any information on this Website or on any other Website to which this Website is linked.

3. Crystal Clear Web Design, by linking to other Websites, does not accept responsibility for nor imply endorsement of any material or information contained therein.

4. Any prices published on the Company's Website are subject to change without prior notice.

5. Crystal Clear Web Design reserves the right to change, edit, or update the policies contained in this document at any time and without prior notice.
